Terms of Use
These terms apply to everyone who uses Lokasell: people looking at homes, owners who list their own, and agents. Agents and agencies also agree to the Agent and Agency Terms.
In short
- Lokasell publishes homes and neighbourhood guides. It is not an estate agent, and it is not part of any sale.
- What a listing says is what its lister says. Check it before you rely on it.
- What you publish stays yours. You let Lokasell show it.
- Keep to the Listing and Content Standards. Lokasell can take down what does not.
Lokasell's company details are still being added. Gaps marked [like this] will be filled in.
Who you are dealing with
Lokasell is run by [Company name] (registration number [SSM number]), of [registered address]. In these terms "Lokasell", "we" and "us" mean that company; "you" means whoever uses Lokasell.
Lokasell is at lokasell.com, at the addresses of agents' pages on it (such as name.lokasell.com), and at the domains of agents whose pages Lokasell serves at a domain of their own. These terms apply at all of them. How to reach us is on Company and contact.
What Lokasell is, and what it is not
Lokasell is a place to publish homes for sale as structured records, agents' own pages, and guides to neighbourhoods written by the agents who know them (Lokalists).
Lokasell is not an estate agent. It does not negotiate, value homes, hold deposits, draw up or witness agreements, or take a commission on any sale. A sale is between the buyer and the seller and the people they appoint, such as their agent, lawyer and bank. Lokasell is not a party to it.
Lokasell does not check the title or the ownership of a home, its condition, or whether what its lister says is true, unless a page says plainly that something was checked. What it means when Lokasell has checked an agent, shown by a shield beside their registration number, is set out on How Lokasell checks.
Using Lokasell
You may look at homes, agents' pages and guides on Lokasell for your own purposes, such as finding a home or comparing them. You must not:
- copy listings, photographs or guides in bulk, or collect them with a program (scraping), except by the search engines that index public pages;
- use a contact detail on Lokasell for anything but asking about the home or the agent it belongs to, and never to send unsolicited marketing;
- try to reach what is not yours: another person's account, a screen you were not given, or Lokasell's systems;
- interfere with Lokasell working, for instance by flooding it with requests;
- pretend to be someone else, or to be checked or appointed when you are not.
Your account
You must be 18 or older to have an account. Give your real name and an email address you read. You are responsible for what is done with your account, so keep your password to yourself, and tell us at [email protected] if you think someone else has used it.
An account lets you list your own home. A registered estate agent or negotiator also sends their registration number from their account for Lokasell to check, and agrees to the Agent and Agency Terms when they do.
You can ask us to close your account at any time (see the Privacy Notice for what happens to what you gave us).
What you publish
What you put on Lokasell (a listing, its photographs, your page, a guide) stays yours, or stays with whoever you have permission from. By publishing it you give Lokasell a non-exclusive, royalty-free licence, for as long as it is on Lokasell and for a reasonable time after, to store it, show it, resize and crop it, translate it, and use it:
- on Lokasell's pages, including the pages of a neighbourhood guide that reaches your listing, and in the previews a page shows when its link is shared;
- in the data search engines read from a public page;
- to show what Lokasell is, as long as it is shown as your listing or page and in its place.
You promise that you may publish it, that it is true, and that it keeps to the Listing and Content Standards. You are responsible for it, and you will cover Lokasell's reasonable costs if someone brings a claim against Lokasell because of it.
Some things are drafted by a computer for you to check, such as social media posts for a listing. A draft is yours once you use it, and you are responsible for checking it first.
Listing your own home
When you publish a home as its owner, you confirm, and Lokasell records that you confirmed, that:
- you own the home, or the owners have agreed to sell it and to you listing it, and you may sell it;
- the home is for sale at the price you give, and you will take the listing down within 7 days of it being sold or no longer for sale;
- you understand the phone number on your account, the home's address and roughly where it is on the map are shown on its public page.
The page of a home listed by its owner says so, and says that Lokasell has not checked its title or who owns it. Lokasell is not your agent and does not act for you in the sale. If you want an agent, appoint one yourself.
If you are looking at a home
A listing is its lister's description. Before you pay anything or sign anything, check the facts that matter to you: see the home, search its title, and take advice from your own lawyer and bank. Estimates on Lokasell, such as a price range, stamp duty and legal fees, or travel times, are a starting point and not advice. How Lokasell checks says what each one is.
If you think a listing is false or a scam, tell us on Report a problem. Never pay a deposit to someone you have only met online without checking who they are.
What Lokasell may do
To keep Lokasell useful and safe, we may, with or without notice:
- edit how a listing or page is shown (but not what it says, without telling its lister), hide it, or take it down;
- refuse, suspend or close an account, or stop a registration being checked, where these terms or the standards are broken, where the law asks it, or to protect the people using Lokasell;
- change, add to or stop parts of Lokasell.
Where it is reasonable to, we tell you what we did and why, and you can reply to [email protected].
Lokasell's name, logo, design and software, and the way it arranges and words its pages, belong to Lokasell. The rules for using the logo are on the brand page.
Responsibility and its limits
We work to keep Lokasell available and accurate, but it is provided as it is, and it may sometimes be unavailable or wrong. So far as the law allows:
- Lokasell is not responsible for what listers, agents and other users publish or do, or for a sale or any part of one;
- Lokasell is not responsible for loss that could not reasonably have been foreseen, or for lost profit, business or opportunity;
- for anything else, Lokasell's total responsibility to you is limited to the greater of what you paid Lokasell in the 12 months before the claim and RM 500.
Nothing in these terms limits responsibility that the law does not allow to be limited, such as for fraud, or takes away rights you have under the law that cannot be taken away.
Changes to these terms
We may change these terms as Lokasell changes. The date at the top says when they last changed. When a change matters to you, we tell you before it takes effect, by email or when you next sign in, and an account holder is asked to accept the new version. If you do not accept it, you can stop using Lokasell and close your account.
The law, and disputes
These terms are governed by the laws of Malaysia. If we disagree, write to [email protected] first and we will try to settle it with you. If we cannot, the courts of [city], Malaysia, will hear it.
If a part of these terms cannot be enforced, the rest still applies. These terms are in English; where a translation differs, the English applies.
