Agent and Agency Terms
These terms are for registered estate agents, negotiators and their agencies. They add to the Terms of Use, which apply as well. An agent accepts them when they send their registration number for Lokasell to check. The Lokalist schedule is accepted separately, by an agent appointed to keep a neighbourhood's guide.
In short
- Only a registered agent may have an agent's page, and only for homes they are authorised to advertise.
- "Checked by Lokasell" means your number matched the Board's register when we looked. It is not an endorsement.
- Your listings and page stay yours; Lokasell shows them, and may take down what breaks the standards.
- Being a Lokalist is an appointment, not a right, and no enquiries or referrals are promised with it.
Lokasell's company details are still being added. Gaps marked [like this] will be filled in.
Your registration
You confirm that you are registered with the Board of Valuers, Appraisers, Estate Agents and Property Managers (BOVAEAP) as a registered estate agent (REA), probationary estate agent (PEA) or real estate negotiator (REN) of a registered firm, and that the registration number you give is yours and in force.
Tell Lokasell at once, at [email protected], if your registration lapses, is suspended or cancelled, or if you leave or change firm. Lokasell takes your page and listings off public view until it has checked your registration again.
Lokasell checks the number you send against the Board's register before your page and listings are public, and may check it again at any time. What the check means, and what it does not, is set out on How Lokasell checks. Lokasell may refuse or withdraw a check where it cannot confirm a registration, or where these terms are broken.
Advertising a home
For every home you publish, you confirm, and Lokasell records that you confirmed, that you hold the written authority of its owner (or of someone entitled to sell it) to advertise it, as the Malaysian Estate Agency Standards require, and that the home is for sale at the price you give.
You are responsible for each of your listings meeting the law and the Board's rules on advertising, including naming your firm and its registration number with your own. Lokasell shows your name, registration number and agency on your listings and page; choose your agency on your page, and ask Lokasell to add it if it is missing.
What a listing says must be true and must keep to the Listing and Content Standards. A false description of a home can be an offence under the Trade Descriptions Act 2011. Take a listing down within 7 days of the home being sold, let, or no longer yours to advertise.
Your page
Your page and your listings stay yours, and you give Lokasell the licence in the Terms of Use to show them. Your page is public at its Lokasell address once your registration is checked, and shows your public name, portrait, registration number, agency, WhatsApp number and the email address on your account.
The words of clients on your page must be real, from clients you acted for, and published with their agreement to be named as you name them. Do not write them yourself or change their meaning. Lokasell may remove words it has reason to doubt.
Your own domain
Where Lokasell agrees to serve your page at a domain of your own, you must own the domain and keep it registered and paid for. Lokasell sets up how it reaches Lokasell; you make the changes to its records that Lokasell asks for and leave them in place. If the domain lapses or its records change, your page is served only at its Lokasell address again. Lokasell may stop serving a domain whose content or name breaks these terms, or the law.
Drafted posts
When you ask for social media posts for a listing, the listing's facts and description are sent to OpenAI, which drafts them. A draft can be wrong. Check every word before you post it; once you post it, it is yours and you are responsible for it.
Your clients and buyers
When a buyer contacts you from your page, by WhatsApp, email or phone, the conversation is between you and them, outside Lokasell. You are responsible for their personal data from then on, under the Personal Data Protection Act 2010: use it only to deal with their enquiry, and never add them to marketing without their consent.
Fees
Lokasell does not charge agents or agencies today. Before any fee applies, Lokasell will publish its plans and prices, and nothing will be charged that you have not chosen. Lokasell takes no share of any commission and does not pay or receive referral fees on any sale.
Suspension and ending
You can stop at any time: unpublish your listings and ask us to close your account. Lokasell may suspend or close an agent's page and listings where these terms are broken, where a registration cannot be confirmed, where the Board or another authority asks it, or to protect buyers and owners. Where it is reasonable to, we tell you first and give you a chance to put it right.
The Lokalist schedule
A Lokalist is a neighbourhood's local specialist on Lokasell: one of the two agents (a lead and a second) appointed to write and keep its guide. This schedule applies to every Lokalist, who accepts it before they first work on a guide. It is in force from 14 October 2026.
The appointment
- Lokasell appoints Lokalists, and may change or end an appointment at any time, with notice where it is reasonable to give it. An appointment is not a right, cannot be passed on, and carries no promise of how long it lasts.
- Being a Lokalist does not stop any other agent listing homes in the neighbourhood, and gives you no say over their listings.
- Lokasell does not pay Lokalists, and Lokalists do not pay Lokasell for an appointment, unless a written agreement says otherwise.
The guide
- Write what you know: places you have been to, travel times you have measured or reasonably estimated, and what is being built as its sources say. Say when something is an estimate.
- Keep it current. A guide not looked after becomes stale, and Lokasell may mark it so, ask another agent to keep it, or take it down.
- Use places found through Google or OpenStreetMap only as their terms allow, and do not copy another publisher's guide.
- Lokasell reviews a guide before it is published, and may edit how it is shown or decline to publish it.
What it reaches
- Once published, the guide appears on every live home in the neighbourhood, whoever listed it, with your name as its Lokalist. Its other listers cannot change it.
- No enquiries, referrals or business are promised with an appointment. Lokasell does not pass you another lister's enquiries, and you must not ask another lister, buyer or owner for a fee because of the guide.
When it ends
The guide you wrote stays on Lokasell, under the licence in the Terms of Use, which for a guide continues after your appointment ends, so the neighbourhood is not left without one. Your name comes off it once another Lokalist keeps it or it is changed so it is no longer your work.
The law
These terms are governed by the laws of Malaysia, and disputes are dealt with as the Terms of Use say. Lokasell may change them as the Terms of Use say, and an agent or Lokalist is asked to accept a new version.
